Before you move forward with any Court case, it is a good\r\n idea to talk with a lawyer to make sure you know your rights and responsibilities,\r\n as well as the possible consequences of proceeding. If you choose to go to court\r\n without a lawyer, you will have to follow the appropriate Indiana statutes, Indiana\r\n Rules of Evidence, Indiana Rules of Trial Procedure, and any local rules. \r\n\r\nPlease note, child support is not officially established or modified until an order\r\n has been issued by the court. In addition, child support will not be modified unless:
\r\n\r\nSee Indiana Code 31-16-8-1 (Modification or revocation of child support order or maintenance order)
\r\n\r\nIn addition to filing a Petition for Dissolution of Marriage or a Petition to Modify\r\n Child Support, you must file the following forms with the court when your case is\r\n heard. (The following forms can be generated by these calculators.)
\r\n\r\nand for children receiving post-secondary education,
\r\n\r\nThe Indiana Child Support\r\n Guidelines always apply to a case in which child support is established\r\n or modified. However, these calculators will not calculate deviations from the Guidelines.\r\n If you have a special circumstance that calls for\r\n deviation,\r\n you must still submit the above forms to the court. You may explain\r\n your special circumstance to the judge, and the judge may then revise these forms\r\n accordingly prior to approving them.
\r\n\r\nAdd the first name or initials, date of birth, and post-secondary education information\r\n (if applicable) for all children for whom the parents share joint legal responsibility\r\n and for whom support is being sought.

You will also need to enter education-related\r\n expenses and any funding the child contributes through grants, scholarships, loans,\r\n and cash.
\r\n\r\nConsideration should be given to extraordinary educational expenses for elementary\r\n and / or secondary education. Unlike for post-secondary education situations, situations\r\n involving extraordinary educational expenses for elementary and secondary schooling\r\n involve adjustments separate from the Indiana Child Support Guidelines worksheet.

Weekly gross income (WGI) is the starting point in determining the child support\r\n obligation, and it must be calculated for both parents. If one or both parents have\r\n no income, then potential income may be calculated and used as weekly gross income.
\r\n\r\nFurther, imputed income may be substituted for, or added to, other income in arriving\r\n at weekly gross income. It includes such items as free housing, a company car that\r\n may be used for personal travel, and reimbursed meals or other items received by\r\n the obligor that reduce his or her living expenses.
\r\n\r\nIn calculating weekly gross income, it is helpful to begin with total income from\r\n all sources. This figure may not be the same as gross income for tax purposes. Means-tested\r\n public assistance programs (those based on income) are excluded from the computation\r\n of weekly gross income, but other government payments, such as social security benefits\r\n and veterans pensions, should be included. Only the income of the parties is included\r\n in Weekly Gross Income. The income of the spouses of the parties is not included\r\n in Weekly Gross Income.
\r\n\r\nThere are special considerations for the self-employed, for those receiving rent\r\n or royalty income, and for the inclusion of irregular income such as overtime, commissions,\r\n bonuses.
\r\n\r\nIncome statements of the parents shall be verified with appropriate documentation.
\r\n\r\n \r\n\r\n\r\nSee \r\n Guideline 3(A) and the associated Commentary\r\n to learn what types of income should be included or excluded from the amounts you’ll\r\n enter below. Income types addressed in this section of the Guidelines include:

The required\r\n worksheet is called the Child Support Obligation Worksheet (CSOW)\r\n and will be generated by this calculator after you finish answering the questions.
\r\n\r\nNow that you've provided a combined weekly gross income, you and the child(ren)'s\r\n other parent may claim certain reductions, which are subtracted from the gross\r\n income to arrive at a combined weekly adjusted income. It is this income amount\r\n that the weekly child support obligation is based on.
\r\n\r\nAn adjustment should be made in arriving at Weekly Gross Income of the\r\n parents in instances where either or both have children who were born or\r\n adopted after the birthdate(s) of the child(ren) subject of the child\r\n support order.

\r\n\r\nThere are two types of adjustments allowed under this category.
\r\n\r\n1: Court ordered child support for prior-born children. The amount(s) of any court order(s)\r\n for child support for prior-born children should be deducted from Weekly Gross Income.
\r\n\r\n2: Legal duty for child support for prior-born children. Where a party has a legal support\r\n duty for children born prior to the child(ren) for whom support is being established,\r\n not by court order, an amount reasonably necessary for such support shall be deducted\r\n from weekly gross income to arrive at Weekly Adjusted Income. This deduction is not allowed\r\n for step-children.

\r\n\r\nSee \r\n Guideline 3(C) and the associated Commentary\r\n to learn how support for prior-children (i.e., children born before the child(ren)\r\n for which you are currently calculating support) affects your weekly income for\r\n the purposes of this calculator.
\r\n\r\nThe amounts of maintenance arising from a prior marriage or the amounts of alimony\r\n ordered in decrees from foreign jurisdictions (other states) should be deducted\r\n from Weekly Gross Income.

\r\n\r\nSee \r\n Guideline 3(C) and the associated Commentary\r\n to learn how alimony (out-of-state) or maintenance (in-state) that you pay affects\r\n your weekly income for the purposes of this calculator. Note that if you receive\r\n maintenance or alimony from a prior marriage, that amount should be included with\r\n your weekly gross income per Guideline 3(A).
\r\nNow that you've entered your income and income adjustments, from which the basic\r\n child support obligation is determined, you and the child(ren)'s other parent may\r\n make adjustments to that basic obligation.
\r\n\r\nSeveral types of adjustments can be made, including:
\r\n\r\nNote that the amounts for work-related child care expenses and health care premiums\r\n are first added to the combined weekly obligation of both parents and then credited\r\n to the parent actually paying these expenses.
\r\n\r\nAnother adjustment may be made if any of your children are engaged in higher education,\r\n but that amount is determined when the child(ren)'s information is entered\r\n and will be reflected on the forms this calculator produces.
\r\n\r\nIn determining a child support obligation, a parenting time credit may be included\r\n as an adjustment to one parent's weekly obligation amount. Details about how the\r\n parenting time credit is calculated and applied are complex and explained in detail\r\n in the Indiana Child Support Guidelines.
\r\n\r\nTo arrive at a parenting time credit, you must consider the number of overnights\r\n each parent spends with the child(ren). An overnight will not always translate into\r\n a twenty-four hour block of time with all of the attendant costs and responsibilities.\r\n It should include, however, the costs of feeding and transporting the child, attending\r\n to school work and the like. Merely providing a child with a place to sleep in order\r\n to obtain a credit is prohibited.

\r\n\r\nChild care costs incurred due to employment or job search of either parent, should\r\n be added to the basic obligation. It includes the separate cost of a sitter, day\r\n care, or like care of a child or children while the custodial parent works or actively\r\n seeks employment. Such child care costs must be reasonable and should not exceed\r\n the level required to provide quality care for the children. Child care costs required\r\n for active job searches are allowable on the same basis as costs required in connection\r\n with employment.
